Why Supreme Court, Other Legal Topics Might be Raised at VP ...

Watching the presidential campaign this year for discussions on legal topics has been a bit like watching for meteors: a lot of waiting, and fleeting when it happens. Both Republicans and Democrats focused on conveying their message about the economy during the national political conventions, with only brief mentions of the Supreme Court and Department of Justice initiatives.

Tonight's prime time vice-presidential debate between GOP Representative Paul Ryan (Wis.) and Vice President Joe Biden could be different. Here are four reasons why:

1. Biden could tap into his deep background with legal issues. As a Senator, Biden, an attorney, spent 16 years as the top-ranking Democrat on the Judiciary Committee, including eight years as the committee's chairman. He presided over two of the most contentious Supreme Court nomination hearings: the confirmation of Clarence Thomas and the unsuccessful bid of Robert Bork, who is now a co-chair of Republican candidate Mitt Romney's Justice Advisory Committee.

2. Ryan's debate preparer is Washington litigator Ted Olson. The Gibson, Dunn & Crutcher partner has been playing the role of Biden in mock debates on the campaign trail, and has brought his 47 years of Washington legal experience with him. Ryan told CNN that Olson, the solicitor general during George W. Bush?s first term, has "immersed himself into being Joe Biden." Ryan also told CNN that: "He (Olson) knows my record, he's studied it, he's studied what we do in Congress, arguments that the president and vice president use to try to win their debates by default."

3. The moderator has asked for suggested questions. ABC News senior foreign affairs correspondent Martha Raddatz solicited questions on Twitter on September 17, and that could open it up to legal issues that voters care about. Raddatz told The Huffington Post that there was not a lot of response, but the Alliance For Justice took the opening and pressed moderators to ask about the kinds of attorneys they would nominate to the Supreme Court. "Of course candidates have stock answers for any question about the Supreme Court," AFJ President Nan Aron wrote in an October 1 letter to Raddatz and other moderators. "We hope you will press them to go beyond the usual boilerplate."

4. The debate format is wide open, and Biden has a reputation for going off script. When Biden made an off-the-cuff remark on "Meet The Press" in May about being "absolutely comfortable" with gay marriage, he apologized to President Barack Obama and the White House clarified that it was not an official change in policy. But three days later, Obama appeared on ABC to state he too believed that same-sex couples should be allowed to marry. By the time the Democratic National Convention finished in September, gay marriage was an official part of the Democrat platform. The debate will cover both foreign and domestic topics and be divided into nine time segments of approximately 10 minutes each. A similar format in the first debate between Obama and Romney produced a surprisingly detailed discussion of the implementation of the Dodd-Frank Wall Street Reform and Consumer Protection Act.

Clinical trial treats heart failure patients with their own stem cells to restore blood flow

MINNEAPOLIS, MN October 11, 2012 Timothy Henry, M.D. of the Minneapolis Heart Institute Foundation treated the first patient in the ATHENA study, injecting the patient's own stem cells into the heart to restore blood flow and help regenerate heart muscle. Henry, the Foundation's Director of Research is co-principal investigator of the ATHENA study sponsored by Cytori Therapeutics. The study will investigate Cytori's adipose-derived cell therapy in patients who suffer from heart failure related to chronic myocardial ischemia.

"Patients who qualify for this study essentially have limited options beyond left ventricular assist devices and heart transplantation," said Dr. Henry, "Patients in the ATHENA study are treated using their own cells taken from fat tissue that are put back into the heart to regenerate tissue, a process that minimizes the risk of rejection. This is an exciting trial which may potentially add an attractive alternative for patients who have a critical need."

The purpose of the study is to see if cells taken from one's own fat can help restore the heart muscle function by growing new blood vessels to improve the blood supply and thereby increase the heart's ability to pump blood. The stem cells will be taken from fat tissue. The stem cells, or placebo, will then be delivered into the heart muscle. Enrollment is expected to complete in mid-2013.

""The ATHENA clinical trial gives us an opportunity to explore the potential for Cytori's cell therapy in heart failure patients," said Marc H. Hedrick, M.D., president, Cytori Therapeutics. "While this is an investigational treatment, we believe that cell therapy will someday become a new option for these heart failure patients and at the same time, lower the cost of care by delaying or preventing patients from needing a transplant or assist device."

Cytori previously reported six and 18-month safety and feasibility data from the PRECISE trial, a European clinical trial for this same indication. The PRECISE trial demonstrated a statistically significant improvement in VO2 Max in patients treated with Cytori's cell therapy compared to those treated with placebo. VO2 Max is an objective functional measurement that can be predictive of outcomes in heart disease, including mortality, and is commonly used as a primary determinant for qualifying patients for heart transplantation. The Company is also conducting the ADVANCE trial, a European pivotal trial investigating the effect of Cytori's cell therapy in heart attack patients.

In addition to the Minneapolis Heart Institute Foundation, the Texas Heart Institute (Houston, TX) is screening patients under the direction of Emerson Perin, M.D., Ph.D., co-principal investigator for ATHENA, and James T. Willerson, M.D. Four additional centers are also expected to participate in the trial including:

  • University of Florida, in Gainesville, FL, Carl Pepine, M.D.
  • University of South Florida, Tampa, FL, Leslie W. Miller, M.D.
  • Scripps Green Hospital in San Diego, California, Richard Schatz, M.D.
  • Cardiology P.C., Birmingham, AL, Farrell Mendlesohn, M.D.

Trojan horse drug therapy provides new approach to treating breast cancer

ScienceDaily (Oct. 2, 2012) ? When Linda Tuttle was diagnosed with breast cancer, she never imagined her experience would inspire her colleagues to design new treatments to tackle the disease.

An administrative assistant in the Department of Chemistry at Wake Forest University, Tuttle was more accustomed to talking to faculty and staff about meetings and course loads -- not doctors' appointments and treatment plans.

But after her 2009 diagnosis, Tuttle's use of tamoxifen, a drug commonly used to treat breast cancer, inspired medicinal chemist Ulrich Bierbach to develop a targeted therapy that delivers a sneak attack to the disease, similar to a Trojan horse.

Trojan horses and targeted warheads

Current platinum-based drugs, such as the blockbuster drug cisplatin, do not work on the most common and most difficult-to-cure types of cancer, including lung and breast.

Building upon more than a decade's work in platinum-based drug research, Bierbach's team now designs synthetic hybrid molecules that more effectively tackle otherwise chemo-resistant cancers, including breast cancer. Results of this work, funded by the National Cancer Institute at the National Institutes of Health, appear in the September 13 issue of the Journal of Medicinal Chemistry.

Results also have led to tumor-seeking magic bullets that attach platinum to endoxifen, a close relative of tamoxifen, and quietly hitch a ride to the diseased cells, as if hidden in a Trojan horse.

"Platinum-based drugs cause severe damage to the DNA in cancer cells. Unfortunately, most cancers are smart enough to cut out the DNA damage and repair it, and that's the starting point for our structural design. We developed a compound that does a good job therapeutically by overwhelming the 'damage repair police' of the cell," said Bierbach, a chemistry professor who recently completed a four-year term with the California Breast Cancer Research Program.

Bierbach said that instead of killing certain cancer cells, cisplatin causes kinks in the DNA strand, which prompt cell enzymes to repair the damage. Wake Forest's new platinum-based molecule has a much higher affinity for DNA than cisplatin and twists it in a way that is not easily identified by the cancerous cell.

Initial preclinical studies have proven Bierbach's army of molecules to be 500 times more powerful than cisplatin in treating non-small cell lung cancer, 80-100 times for pancreatic cancer and up to 10 times for breast cancer.

"Within the next two years, we hope to turn our platinum-based drugs into safer, targeted warheads by attaching them to vehicles that will take them to a specific type of cancer and act as a guided missile," he said.

Hope on the horizon

Offering a safer way of delivery will be an important step in convincing industrial partners and the Food and Drug Administration (FDA) to move forward with clinical testing, which Bierbach estimates could be another three to four years away. Still, he and Tuttle remain encouraged given the progress to date.

For nearly three years, they met several times a week to explore Tuttle's treatment options, discuss possible side effects, and defuse her fears.

"My grandmother had breast cancer. We were even the same age when we were diagnosed," said Tuttle. "Now every time I have a strange pain or a headache, I can't help but wonder if I have another tumor."

But unlike her grandmother, whose late stage breast cancer metastasized, Tuttle's cancer was only stage 1 when a routine mammogram detected it. Today she is in remission following a lumpectomy and radiation therapy, and her quality of life has improved.

Though her prognosis looks promising, she and Bierbach still get together frequently in the halls of the chemistry department to share stories -- hers of how she now lives every day to its fullest, and his of the lab's progress with its challenging research projects.

"Our professional relationship has definitely grown," said Tuttle. "I hope his research group stays as focused as it is now. Every advancement helps."

"Wake Forest's motto is Pro Humanitate, which means 'for humanity,' and it motivates our research group daily," Bierbach added. "Everyone knows someone who has been affected by cancer, and there's a pressing need for more effective and less toxic chemotherapies. The solution starts with some combination of academic curiosity and personal experience, and takes place in a lab that has synthetic chemistry expertise and a good deal of imagination to think about new ways to tackle cancer mechanistically at the molecular level. It's a fulfilling job, but it's even more rewarding to help someone you know."
